Terms of Service

Welcome to DesignPalm. These Terms govern your use of our subscription software products, DesignPalm Chat and MarginStats, and our website at designpalm.com. By creating an account or using either product, you agree to these Terms.

1. Our Products

DesignPalm provides two self-serve, subscription-based software products:

• DesignPalm Chat — an AI chat widget and booking platform for hospitality businesses.
• MarginStats — a profit margin and cost tracking tool for product sellers.

Both products are billed on a recurring monthly (or annual, where offered) subscription basis. There are no custom development projects, proposals, or separate service agreements — every customer uses the same product on the same published pricing.

2. Accounts & Free Trials

Each product offers a free trial. You can sign up and use the trial without providing payment details. If you choose to continue after your trial, you'll be billed automatically at the published subscription rate for the plan you select.

You're responsible for maintaining accurate account information and for all activity that occurs under your account.

3. Billing

Subscriptions are billed automatically on a recurring basis (monthly or annually, depending on the plan you choose) until cancelled. All payments are processed by Paddle.com Market Limited, our Merchant of Record, who handles billing, sales tax/VAT, and payment collection on our behalf.

4. Acceptable Use

You agree not to:

• Use either product for any unlawful purpose
• Attempt to reverse-engineer, resell, or white-label the software without our written consent
• Interfere with the normal operation of the service or attempt unauthorized access

5. Intellectual Property

DesignPalm Chat, MarginStats, and all associated software, branding, and content remain the property of DesignPalm. Your subscription grants you a license to use the software for your business, not ownership of the underlying code or platform. Any data you input (e.g., your product costs, guest conversations) remains yours.

6. Limitation of Liability

DesignPalm is not liable for:

• Third-party services we rely on (e.g., hosting, email delivery, payment processing)
• Indirect or consequential damages, including lost profits
• Downtime caused by circumstances outside our reasonable control

7. Cancellation & Termination

You may cancel your subscription at any time from your account dashboard; cancellation takes effect at the end of your current billing period. We may suspend or terminate accounts that violate these Terms.

8. Governing Law

These Terms are governed by the laws of Zambia.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted here with a revised date. Continued use of our products after changes take effect constitutes acceptance of the updated Terms.
